Terms of Service

Before you start
These Terms are a contract between you and Piotr Kucharski, trading as "Piotr Kucharski Bioinformatyka", a Polish sole proprietorship (ul. Meksykańska 3 lok. 14, 03-948 Warszawa, Poland, NIP 1133118497, REGON 527213825), referred to here as "we," "us," or "the Provider," for your use of Word2Mail: the browser extension, the web dashboard at word2mail.com, and the services behind them (together, the "Service").
If you are an EU consumer, read Section 7 before you buy anything.
By creating an account, installing the extension, or clicking to accept, you agree to these Terms.
1. Words with a specific meaning here
- "Account": your Word2Mail profile, created by signing in with your Google or Microsoft account, tracking your plan, quota, preferences, and feedback history.
- "AI Output": any draft, reply, or summary the Service generates from your input.
- "Custom Instructions": optional free text you save to steer how AI Output is written for you.
- "Generation": one instance of the Service producing AI Output, consuming quota.
- "Generation Pack": a one-time purchase of extra Generation credits, valid for 12 months from the date they're granted (see Section 6.4).
- "Plan" or "Subscription": the tier you're on (free or paid), with the quota and features shown on the pricing page, which is part of this Agreement by reference.
- "User Content": everything you give the Service for a Generation: what you dictate, what you type in the message window, the content of the thread you are replying to, Custom Instructions, and any other text you provide.
- "AI model provider": the external party that produces AI Output on our instructions. Who that is today, and exactly what data reaches them, is set out in the table in Section 5 of our Privacy Policy. You accept the Privacy Policy together with these Terms, in one statement at checkout.
- "Consumer": a natural person entering into a transaction with the Provider that is not directly connected with their business or professional activity (Article 22¹ of the Polish Civil Code), as well as a natural person entering into a contract directly connected with their business activity where the contract is not of a professional character for them, to the extent the law grants them consumer protection (Article 385⁵ of the Civil Code and Article 7aa of the Consumer Rights Act). Where these Terms use "Consumer", the mandatory consumer protections of the governing law apply and cannot be waived by this Agreement.
2. What Word2Mail actually does
2.1 Core features
- What you give it, meaning speak or type: you can record what it's about with your voice, or type a few words in the message window. You can do one, the other, or both at once. Recording is optional: the Service works fully even if you never use a microphone.
- Thread awareness: when you reply, the extension reads the open thread: see Section 4.1; when you write a new message, it reads no correspondence at all.
- AI drafting: what you gave it, together with the thread content if you are replying, is passed to the AI model provider, which produces a draft, reply, or summary. Speech recognition and drafting both happen outside your browser.
- Feedback and bonus credits: rating a Generation (like/dislike) may earn you bonus Generations under a program that can be adjusted from time to time.
- Automated prompt/model selection: the prompt template and model variant are selected automatically for each request, based on aggregate results across all users, not your individual profile.
2.2 What we don't keep
Your input and the thread you are replying to go to the AI model provider solely to produce that one draft. We do not store them on our servers: we delete them the moment the Generation is complete, whether you speak or type. What we do keep is described in our Privacy Policy: mainly technical metadata about each Generation, never the content.
2.3 What you need to use it
The Service works in at least Google Chrome and Mozilla Firefox, for which we publish the extension; in other Chromium-based browsers (Microsoft Edge, for instance) the Chrome Web Store build usually installs and works, but we do not publish a separate package for them and do not test them separately; and with the Gmail and Outlook web mailboxes. Support for further browsers and mail providers may be extended; extending it never narrows the scope set out above. You also need a Word2Mail account created at sign-in (Section 3.2), a stable internet connection, and JavaScript enabled. Recording needs a microphone and your browser's permission to use it; if you don't have one, or you simply prefer to type, the Service works fully with typed input.
2.4 We may change the Service
We can add, modify, or retire features to improve performance, security, or legal compliance. If a change materially reduces what you're paying for, we'll tell you in line with Section 13.
3. Your account
3.1 Who can sign up
You confirm that you're at least 16 (or the age of digital consent where you live), able to enter a binding contract, and not barred from using this kind of service under any applicable law or sanctions list.
3.2 Signing in
You sign in with your Google account or your Microsoft account: your choice. This authenticates you: signing in does not, by itself, request access to your mailbox content, in Gmail or in Outlook; see Section 4 for exactly how the Service reads the thread you are working on. Keep the account you sign in with secure; tell us at admin@word2mail.com if you suspect unauthorized use of your Account.
3.3 Keep your details accurate
Give us accurate information when it's requested (e.g. billing details) and keep it current. We may suspend or close an Account built on materially false information.
4. How we read your email thread, and our promises about it
4.1 What exactly we read
When you reply, the extension reads the sender and the visible content of the thread you currently have open in Gmail (mail.google.com) or Outlook on the web (outlook.live.com, outlook.office.com, outlook.office365.com), the same text already visible to you, so the AI Output fits the conversation; beyond that it does not reach into your mailbox. It also runs on our own pages, solely to sign you in and connect it to your account; it runs on no other website.
4.2 Our commitments
Our use of information received from Google APIs adheres to the Chrome Web Store User Data Policy, including the Limited Use requirements. The details of these commitments are set out in Section 3.4 of our Privacy Policy.
4.3 Turning it off
Uninstalling the extension stops all thread reading immediately, in Gmail and in Outlook alike. You can also revoke Word2Mail's access at the provider you sign in with: for a Google account at https://myaccount.google.com/permissions, for a Microsoft account at https://account.microsoft.com/privacy/app-access. This does not automatically cancel a paid Subscription: cancel that separately in the dashboard (Section 6).
5. Using the Service responsibly
5.1 License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the extension and dashboard, for your own use.
5.2 Prohibited uses
- Reverse-engineer, decompile, or build derivative works of the Service, beyond what the law allows despite this restriction.
- Bypass or disable any access control or security mechanism.
- Use the Service to build a competing product.
- Scrape or automate access outside normal use.
- Create multiple free-tier Accounts to rack up, in total, more free Generations than one Account's free tier gives you.
5.3 Sharing your Account
You may share your Account's login with other people. Your Generation quota is fixed per Account no matter how many people use it, and everyone using it sees all AI Output and Generation history on it. You are responsible for everything that happens under your Account; this does not limit consumer rights we cannot waive.
5.4 Acceptable use of AI Output
Don't use the Service to draft, send, or facilitate: illegal activity; content that sexualizes or endangers minors; hateful or violent content targeting people or groups; spam, phishing, or malware distribution; impersonation of a real person or organization; or fraud aimed at deceiving people or markets.
Don't rely on the AI Output, without your own human review, for medical advice, legally binding contracts, emergency communications, or anything where a mistake could cause real harm.
5.5 Custom Instructions are your responsibility
You're responsible for what you put in your Custom Instructions. We may sanitize or reject instructions that clearly violate Section 5.4. Breaking this Acceptable Use section can lead to immediate Account termination without refund.
5.6 Updates
The extension may auto-update via your browser's extension store. Using the Service means accepting these updates.
6. Money: plans, purchases, and quota
The Service has a free tier with limited monthly quota, and paid plans with more. Current pricing, quotas, and features are shown on the pricing page and are part of this Agreement by reference; they can change (see Section 6.5).
6.1 Payments
All payments are processed by our third-party payment processor. Buying a plan or a Generation Pack authorizes us, via that payment processor, to charge your payment method for that purchase.
6.2 Subscriptions auto-renew
Paid Subscriptions renew automatically at the end of each billing period unless you cancel first from the dashboard's billing settings. We'll give advance notice before an annual renewal as required by law.
6.3 How quota is spent
Each Generation uses one quota unit, drawn in this order: (1) your monthly Subscription quota, (2) bonus Generations earned through the feedback program, (3) purchased Generation Pack credits. When all three are exhausted, generation stops until your quota resets, you earn or buy more, or you upgrade.
Quota is used by any request that ends in a generated message: including one where you provide neither a recording nor text. In that case the Service writes a polite, general reply from the thread alone, and that is a full Generation. We do not charge quota for a request that failed and returned you no content.
6.4 Generation Packs and bonus credits
Purchased Generation Pack credits, and any bonus credits granted when you upgrade your Subscription, are valid for 12 months from the date they're granted. Unused credits expire once that period ends. They aren't touched by your monthly reset and are spent only after your monthly and bonus quota run out, oldest-expiring credits first; they're non-refundable once purchased except as the law requires. Feedback bonus credits don't expire and otherwise work the same way, but can't be bought, sold, or transferred, and the terms of the feedback program can change.
6.5 If we change prices
We'll give at least 30 days' notice by email before a price increase takes effect. If you don't agree, you can cancel before the new price applies. During any beta period, pricing may be introductory and lower than the eventual standard price, which will also be announced in advance.
6.6 Plan changes
Upgrading takes effect immediately: we charge the full price of the new tier right away (not a prorated top-up), and your billing cycle restarts from that moment. Any quota you hadn't used yet on your old tier is credited to you as Generation Pack-style purchased credits, valid for 12 months under the same rule as Section 6.4. Downgrades work differently: they take effect at the end of your current billing period, so you keep your current tier's access and quota until then, with no refund for the time already paid.
6.7 If a payment fails
Your access is governed by your remaining quota. A failed renewal means your Subscription won't add new monthly quota, so once what you have runs out, you're limited to the free tier's quota until payment is resolved. We'll email you about the failed payment and how to fix it via the payment processor's customer portal; once payment succeeds, your Subscription resumes normally.
6.8 Payment disputes (chargebacks)
If you file a chargeback, we may suspend paid-feature access while it's open, and will tell you why. If it's resolved in your favor, access is restored; if resolved against you, your Account moves to the free tier.
6.9 Refunds
Refunds are at our discretion or as the law requires, including where your withdrawal right (see Section 7 below) wasn't validly waived, or the Service was defective. We generally don't refund partially used Subscription periods or unused Generation Pack credits beyond that. If you think you were billed in error, tell us at admin@word2mail.com within 30 days.
7. If you're an EU/UK consumer: your 14-day right, and its limit
7.1 The general rule
Under the EU Consumer Rights Directive and Polish consumer law, you normally have 14 days to withdraw from an online purchase without giving a reason.
7.2 Why that doesn't apply once you start using a Generation Pack or Subscription
Word2Mail is both digital content not supplied on a tangible medium and a digital service, under the Polish Consumer Rights Act of 30 May 2014. Before you complete a paid purchase, we ask you to explicitly confirm two things: (a) that you request performance to begin (delivery of the digital content, or provision of the service) before the 14-day withdrawal period ends, and (b) that you accept that you therefore lose your right of withdrawal: to the extent the contract covers the supply of digital content, once performance begins (art. 38(1)(13) of that Act), and to the extent it covers the provision of a digital service, once that service has been fully performed (art. 38(1)(1) of that Act; the obligation to take that acknowledgement from you comes from art. 21(2) of the same Act). You'll see this as an explicit checkbox at checkout: once each for your first Subscription, and separately for every one-time Generation Pack purchase.
7.3 If you didn't get that checkbox, or something went wrong
If the waiver wasn't properly presented, or the Service was materially defective, your statutory withdrawal right (or a refund) still applies. Contact admin@word2mail.com.
7.4 Market launch waitlist
If we don't yet support your country, you may submit your email address to be notified when we do. This is a free, one-time notification service: not a subscription, and not a contract for the paid Service. You may withdraw at any time using the unsubscribe link tied to your email address, with no login required.
8. Who owns what
8.1 Our side
The Service (its code, design, and the Word2Mail name and branding) belongs to Piotr Kucharski (via "Piotr Kucharski Bioinformatyka") and is licensed to you only as described in Section 5.1. This Agreement gives you no right to our trademarks or branding beyond that.
8.2 Your side
You keep all rights to your User Content. To the extent the law lets us, we assign you all rights in the AI Output generated for you: it's yours to send, edit, or discard. You're solely responsible for what you actually send; we're a technical tool, not the sender.
8.3 No training on your data
We don't use your User Content to train our own models.
9. AI output comes with no warranty
9.1 "As is"
TO THE EXTENT THE LAW ALLOWS, THE SERVICE IS PROVIDED "AS IS," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 AI limitations
The AI can be wrong. It may generate text that's inaccurate, irrelevant, or inappropriate. We don't manually review AI Output before you see it. You're solely responsible for reviewing and editing anything before you send it. Which specific prompt template and model variant handled your request is chosen automatically (Section 2.1(5)): we don't guarantee any particular one will be used.
9.3 Uptime
We don't guarantee uninterrupted or error-free operation. The Service depends on third-party APIs and infrastructure; outages on their end are outside our control.
10. Liability
10.1 What's excluded
TO THE EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING FROM YOUR USE OF THE SERVICE, HOWEVER CAUSED.
10.2 The cap
OUR TOTAL LIABILITY UNDER THIS AGREEMENT IS LIMITED TO WHAT YOU ACTUALLY PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR PLN 500, WHICHEVER IS GREATER. This cap does not apply to consumers to the extent it would be an unfair contract term (Article 385(1) of the Polish Civil Code) or would conflict with mandatory law, and it never covers damage caused intentionally (Article 473 § 2 of the Polish Civil Code).
11. If your use of the Service harms someone else
You agree to indemnify and hold us harmless against claims, damages, and reasonable legal costs arising from: your breach of this Agreement or Section 5's Acceptable Use rules; your misuse of the Service; your infringement of someone else's rights; or the content of any email you send using the Service, including your Custom Instructions.
12. Ending this Agreement
12.1 You can leave any time
Uninstall the extension and stop using the Service. If you have a paid Subscription, cancel it separately before the renewal date to avoid further charges.
12.2 We can end it too
We may suspend or terminate your access, without notice, if you materially breach this Agreement (especially Section 5's Acceptable Use rules), if the law or Google requires it, or if we discontinue the Service.
12.3 What happens after
Your license ends, you must stop using the Service, and we may delete your Account data per our Privacy Policy. Sections 8, 9, 10, 11 and 14 survive termination.
12.4 If we shut the Service down entirely
We'll give at least 90 days' notice to users with unused Generation Pack credits, so you have a fair window to use them before the Service ends.
13. Changes to these Terms
We may update these Terms. Material changes (payment terms, liability, or how we handle your data) get at least 15 days' notice by email or in-app prompt before taking effect. Continuing to use the Service after that means you accept the update; if you don't, please stop using the Service and cancel your Subscription before the change takes effect. A change to these Terms cannot take away rights a consumer already acquired on the earlier terms, for the Subscription period already paid for or for Generation Packs already purchased.
14. Governing law and disputes
14.1 Law
This Agreement is governed by Polish law, excluding conflict-of-law rules and the CISG.
14.2 Where disputes go
Courts in Warsaw, Poland have jurisdiction. If you are an EU consumer, this does not narrow your statutory position: under Article 18(1) of Regulation (EU) 1215/2012 you may sue us either in the courts of your own domicile or in the courts of ours, and we may sue you only in the courts of your domicile.
14.3 Out-of-court dispute resolution
The European Commission maintains a list of approved alternative dispute resolution bodies at consumer-redress.ec.europa.eu. In Poland you can also turn to the President of the Office of Competition and Consumer Protection (polubowne.uokik.gov.pl), to your district (municipal) consumer ombudsman, to a regional inspector of the Trade Inspection (out-of-court proceedings), or to a consumer organisation such as Federacja Konsumentów. We are not obliged to use a consumer arbitration board.
15. Complaints procedure
Not happy with the Service or with another feature we provide electronically (including the market launch waitlist)? Email admin@word2mail.com with the subject line "Complaint," including your account email, what happened, when, and what you'd like us to do about it. We'll respond within 14 days of receiving your complaint; if it needs more investigation, we'll tell you the expected timeline within that window. If you're still unsatisfied, see Section 14.3 for out-of-court options, or go to court as described in Section 14.2.
16. A few last things
- Entire agreement: this Agreement, plus our Privacy Policy and the pricing terms on the website, is the whole deal between us and replaces any earlier version.
- Severability: if a clause turns out to be unenforceable, the rest stays in effect.
- Assignment: you can't transfer this Agreement without our written consent; we may transfer it if we merge with or are acquired by another company, or sell the business.
- Language: if you live in Poland when the contract is concluded, the Polish version of these Terms governs: even if you browsed the site in another language. In all other cases the English version governs. The other language version is then for convenience only, and it never limits rights you have under the mandatory law of your country of habitual residence.
